The Federal High Court in Abuja has struck out a suit filed by Lagos State Governor, Babajide Sanwo-Olu, seeking to restrain the Economic and Financial Crimes Commission (EFCC) from arresting him at the end of his tenure.
According to reports by News Agency of Nigeria, the Presiding Judge, Joyce Abdulmalik, dismissed the suit after Sanwo-Olu’s counsel, Gbenga Femi Akande, moved the motion to discontinue the case.
The court struck out the case on October 31.
The lawsuit was filed in October, with Sanwo-Olu’s lawyer, Darlington Ozurumba, arguing that the alleged plan to arrest the Governor is “unconstitutional and a flagrant violation of his fundamental right to personal liberty and freedom of movement.”
The EFCC had described the legal action as speculative and a “mere conjecture.”
In a counter affidavit, the anti-graft agency stated that it is not investigating the Governor and has never threatened to arrest him or his staff.
In a surprising turn of events, the EFCC’s counsel, Hadiza Afegbua, appeared in court on Tuesday, only to discover that the case had been struck out.
